Terms of Service

Welcome to Forkestrate! These Terms of Service (“Terms”) govern your access to and use of the Forkestrate application, website, and related services (collectively, the “Services”). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, please refrain from using the Services.

1. Acceptance of Terms

By creating an account, accessing, or using the Services, you acknowledge that you have read, understood, and agree to these Terms. If you are using the Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Eligibility

You must be at least 13 years old (or the age of majority in your jurisdiction) to use Forkestrate. By using our Services, you represent that you meet this requirement. If you do not meet the age requirement, you may not access or use the Services.

3. Your Account

3.1 Account Responsibility
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access or use of your account.

3.2 Accuracy of Information
You agree to provide accurate, current, and complete information when creating your account and to update it as necessary.

4. Use of the Services

4.1 License to Use
Forkestrate grants you a limited, non-exclusive, non-transferable, and revocable license to access and use the Services for personal, non-commercial purposes, subject to these Terms.

4.2 Restrictions
You agree not to:

• Use the Services for any unlawful purpose or in violation of applicable laws.
• Reverse engineer, decompile, or disassemble any aspect of the Services.
• Exploit, resell, or use the Services for commercial gain without our prior written consent.
• Interfere with the security or functionality of the Services.

5. User Content

5.1 Ownership of Content
You retain ownership of any content you submit, post, or share through the Services (“User Content”). By submitting User Content, you grant Forkestrate a worldwide, royalty-free, sublicensable license to use, store, display, reproduce, and modify your User Content solely for the purpose of operating and improving the Services.

5.2 Prohibited Content
You agree not to post or share content that:

• Is illegal, harmful, or offensive.
• Violates intellectual property or privacy rights of others.
• Contains malware, spam, or other harmful materials.

6. AI-Generated Features

Forkestrate’s AI-powered tools are designed to assist and enhance your cooking experience. By using these tools, you acknowledge that AI-generated outputs may occasionally be inaccurate or unexpected. You agree not to rely solely on AI outputs for decisions that may cause harm.

7. Privacy

Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the Services, you consent to the collection and use of your information as described in the Privacy Policy.

8. Intellectual Property

All content, features, and functionality of the Services (excluding User Content) are owned by Forkestrate and its licensors. This includes but is not limited to text, graphics, logos, software, and design elements. You may not use any of Forkestrate’s intellectual property without prior written permission.

9. Termination

We reserve the right to suspend or terminate your access to the Services at any time, for any reason, including but not limited to a violation of these Terms. Upon termination, your license to use the Services will cease immediately.

10. Disclaimers and Limitation of Liability

10.1 Disclaimers
‍The Services are provided on an “as is” and “as available” basis without warranties of any kind, either express or implied. Forkestrate does not guarantee that the Services will be error-free or uninterrupted.

10.2 Limitation of Liability
To the maximum extent permitted by law, Forkestrate and its affiliates are not liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of the Services.

11. Indemnification

You agree to indemnify and hold Forkestrate harmless from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the Services, your User Content, or your violation of these Terms.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Effective Date” and notify you of significant changes via email or app notifications. Your continued use of the Services after changes are made constitutes your acceptance of the updated Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law principles. Any disputes arising from or related to these Terms or the Services shall be resolved exclusively through arbitration in Ontario, Canada. Arbitration will be conducted in English and in accordance with the rules of the Arbitration Act of Ontario. For users outside of Canada, local consumer protection laws may apply where mandatory. However, by using the Services, you expressly waive any right to bring disputes in a forum outside of arbitration, except where prohibited by law.
